Unless expressly stated in these Terms and Conditions, you may not share, copy, reproduce, publish, transmit, display, distribute, make available to the public, or otherwise use the Site content in any way. You also agree not to adapt, alter or create a derivative work from any of the Site’s content. Subject to an express permissions contained in these Terms and Conditions any other use of the Site’s content requires the prior written permission of Fytexia. 

You agree to use the Site only for lawful purposes in accordance with these Terms and Conditions, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the Site. THE SITE IS INTENDED TO PROVIDE INFORMATION ABOUT FYTEXIA’S INGREDIENTS, USED IN VARIOUS FOOD/DIETARY SUPPLEMENT PRODUCTS AROUND THE WORLD. IT IS INTENDED TO PROVIDE INFORMATION TO FOOD/DIETARY SUPPLEMENT PROFESSIONALS AND IS NOT DESIGNED FOR THE GENERAL PUBLIC.  AS FYTEXIA’S INGREDIENTS ARE BEING MARKETED IN A LARGE NUMBER OF COUNTRIES, IT IS YOUR RESPONSIBILITY TO ENSURE THAT THE USE OF THE INGREDIENT AND ANY CLAIM MADE IN THE LABELLING OR ADVERTISING OF THE INGREDIENT OR FINISHED PRODUCT COMPLY WITH THE APPLICABLE RULES AND REGULATIONS OF THE COUNTRY OR COUNTRIES IN WHICH THE PRODUCT IS TO BE SOLD. 

To the maximum extent permitted by law, under no circumstances will Fytexia be liable for any of the following losses or direct, indirect damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue, anticipated profits or contracts; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) wasted management or office time or (g) losses suffered by third parties, whether cause by tort (including negligence), breach of contract or otherwise, even if foreseeable arising from the use of the Site regardless of the form of action. 

Fytexia does not warrant that the access to the Site will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available is free of viruses or bugs. These Terms and Conditions and the agreement they create, shall be governed by and construed in accordance with the laws of France. We both agree to the exclusive jurisdiction of the courts of Montpellier. If any provision of this agreement is unlawful, void or unenforceable, that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein. Fytexia may modify these Terms and Conditions, without notice, at any time by updating this posting. If you wish to download materials in the Data Centre section of the Site, you will be required to submit an application form to Fytexia.  Following receipt of the application form, Fytexia, in its sole discretion, may grant you a non-exclusive, limited, revocable licence to access and download certain materials (Downloaded Materials) solely for educational and commercial purposes.  You acknowledge that: (i) Downloaded Materials are proprietary to or licensed by Fytexia, protected under copyright and other intellectual property laws, and may not be shared, copied, reproduced, published, transmitted, displayed, distributed or otherwise made available to any third party without the express prior written consent of Fytexia; and (ii) and the use of the Downloaded Materials is subject to the remaining provisions of these Terms and Conditions. You shall fully indemnify Fytexia for any loss or damage suffered by Fytexia or any of its group companies for breach of this licence. Fytexia may terminate this licence for any reason whatsoever by giving written notice at any time, without affecting any other right or remedy available to it. Upon termination of this licence, you shall immediately destroy all copies of Downloaded Materials which are in your possession, custody or control.
